Acting in its capacity as investment manager for (i) Levin Capital Trilogy Master Fund, Ltd., and (ii) Island Drive Aggressive Short Fund, Ltd. (the "Funds"). Both Funds are invested in the shares of Apen AG. Various separately managed investment accounts, including Levin family accounts over which John A. Levin exercises control also are invested in shares of Apen AG. John A. Levin maintains a controlling interest in Levin Capital Strategies, LP. In addition, John A. Levin controls the general partner of Levin Capital Trilogy Partners, LP, which invests in Levin Capital Trilogy Master Fund, Ltd. through a master-feeder structure. John A. Levin is also an indirect investor in Levin Capital Trilogy Master Fund, Ltd. through its feeder funds.
