Based on article 20 of the Federal Act on Stock Exchanges and Securities Trading (SESTA) UBS AG, Bahnhofstrasse 45, 8098 Zurich, received the following information from the Swiss Confederation, represented by the Federal Department of Finance, Federal Finance Administration, Bundesgasse 3, 3003 Berne for publication. As of 26 November 2008, the Swiss Confederation held acquisition positions relating to 329,447,681 shares of UBS AG which corresponds to 9.326 % of the total share capital of UBS AG. By recommendation of the Disclosure Office of the SIX Swiss Exchange dated 17 November 2008, the Swiss Confederation was granted an exemption to the effect that the basis of the present calculation of the proportion of voting rights may be the share capital currently recorded in the commercial register plus the maximal number of shares of UBS AG to be issued upon the future conversion of the Mandatory Convertible Notes issued in March 2008 and December 2008 in the aggregate amount of CHF 13 billion and CHF 6 billion, respectively, being a total number of 3,532,427,903 shares of UBS AG. This disclosure is being made pursuant to the simplification of the reporting requirements through the Disclosure Office of the SIX Swiss Exchange.
